The FIR was filed by Malabar police on October 30 based on a complaint by Bhagwanram Bishnoi, who had wanted to buy a 1,360sq ft flat in Radha Krishna Cooperative Housing Society for Rs 10.9 crore.
The project was earlier approved in 2017 and it was to cost Rs 67.3 crore, did not take off and a revised approval of Rs 202 crore was given on Monday.
This March, Damani and his brother Gopichand purchased a ground-plus-two floor bungalow at Malabar Hill for Rs 1,001 crore. The bungalow stood on land leased in 1939 to Govindlal Bansilal, later transferred to Premchand Roychand & Sons LLP.
The ground plus two storey-bungalow Madhukunj on leafy Narayan Dabholkar Marg is spread over 1.5-acre land parcel and has total built up area of around 60,000 sq ft. The market price based on the ready reckoner rate is around Rs 724 crore.
The petition said that as a result of the extensive piling and construction activities by developers, the “protected monument and Grade-I heritage structure” was being severely affected.
