The recovery warrant orders are issued by the authority if the developer does not abide by the compensation order. The property of the disputed developer is attached by the collectorate and then auctioned to compensate the aggrieved party.
The initiative by ICICI Bank offers builders instant generation of account numbers for registration with the RERA, better statutory payments efficiently and also enables them to manage payment obligations to vendors, employees and utility providers.
A bench of Justices D Y Chandrachud and Hima Kohli warned that if the requisite responses are not filed within the stipulated time, principal secretaries of housing and urban development shall be present in court to explain the delay.
The ORERA order said: "In case of delivery of possession, the civil court is well equipped to enforce an order through the process of the court. The authority does not possess the power of a magistrate to direct a party to serve civil prison in case of violation."
In December 2021, the RERA had issued an order asking the DDA to get the projects registered to protect the interests of homebuyers but the DDA filed an appeal in the case.
As per the statement issued by RERA, Bihar, people providing authentic information regarding the violation of the Act, would be rewarded by the authority.
The newly introduced allotment letter would require developers to mention the date of handing over the possession of the booked property, percentage of charges levied on cancellation of booking, parking allotment and other details.
HC has passed these orders while observing that several cases being filed by the people from these states conveyed their grouse against the non-fulfilment of promises made by the state agencies in developing various housing projects.
The decision came only days after the authority made it essential for builders to register projects with a total developed area of more than 500 square metres, regardless of the number of flats constructed on it.
The government may also seek state governments to provide their inputs in this matter with an objective of making Rera more effective and offering an impactful recourse mechanism to homebuyers. The decision to this effect was taken in the recent meeting of the Central Advisory Council (CAC).
